Terms and Conditions

ACS Canada Certification Inc.

1. Introduction

At ACS Canada Certification Inc., we are dedicated to delivering professional, impartial, and credible certification services. These Terms and Conditions apply to all contractual engagements related to management system audits and certification, including Stage 1, Stage 2, surveillance, and recertification audits.

2. Commitment to Impartiality and Transparency

ACS Canada operates under the principles of impartiality, confidentiality, and responsiveness in full alignment with ISO/IEC 17021-1. Oversight is maintained through our internal policies and an independent Impartiality Committee.

3. Scope of Services

ACS Canada Certification provides independent, third-party auditing and certification services only. Each engagement is governed by a formal proposal and audit methodology.

All appeals, complaints, and disputes are logged, acknowledged, and investigated promptly. Investigations are conducted impartially and corrective actions are monitored for effectiveness.

8. Confidentiality and Privacy Notice

ACS Canada Certification ensures the protection of all personal and business information. All data is handled with strict confidentiality and will not be shared except as required by law or accreditation rules.

9. Certification Decisions, Suspension & Withdrawal

Certification may be suspended, reduced, or withdrawn in cases of noncompliance, misrepresentation, or breach of contract. Clients will be notified with reasons and required actions.

10. Fees and Payment Terms

Fees are defined in the agreed Contract Proposal. Invoices are payable within 15 days. Cancellation may incur administrative or travel-related charges. Refer to our Travel & Expense Policy for details.

11. Limitation of Liability

ACS Canada’s liability is limited to the total fees paid for the specific certification services rendered. We are not liable for indirect, incidental, or consequential damages.

12. Force Majeure

ACS shall not be held liable for delays or failure to perform obligations due to events beyond reasonable control such as natural disasters, pandemics, or regulatory changes.

13. Acknowledgment of Due Diligence, Full Acceptance, and Waiver of Post-Payment Claims

The payment of any invoice issued by ACS Canada Certification Inc. by the client (whether a natural person or a legal entity) shall constitute an irrevocable, unconditional, and binding acknowledgment that the client has conducted all necessary due diligence and investigations prior to payment, including, but not limited to, inquiries regarding the type, scope, nature, limitations, conditions, legal obligations, accreditation body requirements, and certification recognition applicable to the requested certificate, whether related to management systems, product, or training certification.

By making such payment, the client expressly and unequivocally affirms that they have fully reviewed, understood, and agreed to all terms, conditions, and provisions as stated in the relevant invoice, proposal, quotation, or contract issued by ACS Canada Certification Inc. Accordingly, the client irrevocably waives any and all rights to raise objections, claims, demands, complaints, refund requests, or appeals after payment has been made, including but not limited to objections based on lack of knowledge, misunderstanding, misinterpretation, change of intent, or any other justification.

This clause shall be legally binding, fully enforceable, and shall apply to all invoices and payments made by the client in relation to any certification services, whether for management systems, training, or product certification, provided by ACS Canada Certification Inc.

14. Governing Law

These Terms are governed by the laws of the Province of British Columbia. Any disputes shall be resolved in the courts of Vancouver, BC.
